United States ex rel. Gerald Mayo v. Satan and His Staff

Plaintiff filed suit against Satan and his staff for violation of his civil rights. Among the allegations were: (1) that Satan had on numerous occasions caused him misery and unwarranted threats, all against his will; (2) that Satan had placed deliberate obstacles in his path that caused Plaintiff’s downfall; and (3) that by reason of the foregoing acts, Satan had deprived him of his constitutional rights.
في عام 1971 رفع الحق العام الأمريكي دعوى بناء على بلاغ من جيرالد مايو ضد إبليس وأعوانه. وادعى المدعي أنَّ إبليس وأعوانه قد انتهكوا حقوق المدعي المدنية ومنها: 1) أن إبليس في عدة مواقف تسبب للمدعي المعاناة وحياة البؤس وهدد حياته عدة مرات دون وجه حق، وأن 2) إبليس وضع العوائق عمداً في طريق المدعي ما تسبب في وقوع المدعي إلى الحضيض و3) أن إبليس نتيجة الأفعال المنسوبة إليه السابقة تسبب في حرمان المدعي من حقوقه الدستورية.
The court noted that, “Even if plaintiff’s complaint reveals a prima facie recital of the infringement of the civil rights of a citizen of the United States, the Court has serious doubts that the complaint reveals a cause of action upon which relief can be granted by the court.”
قرار المحكمة:
لدى الإطلاع على أوراق القضية استنتجت المحكمة “أنه حتى لو تبين من خلال الدعوى التي رفعها المدعي وجود ما يسمى بالوجاهة الحيثية للقضية بشأن وجود انتهاك للحقوق المدنية لمواطن ما، فهناك شك كبير لدى المحكمة في أنَّ الدعوى قد سبَّبت الأفعال التي يريد المدعي أن يحصل على انتصاف المحكمة بشأنها.”
The court went on about its concerns and further noted, “We question whether plaintiff may obtain personal jurisdiction over the defendant in this judicial district …. the plaintiff has failed to include with his complaint the required form of instructions for the United States Marshal for directions as to service of process.”
ثم قالت المحكمة “إنَّ السؤال ما إذا كان المدعي قادراً على إثبات أنَّ المحكمة التي يترافع فيها المدعي لها الولاية القضائية على القضية علماً أنَّ المدعي لم يذكر في لائحة الدعوى عنوان التبليغ بناءً على التعليمات واجبة التطبيق” (أي عنوان تبليغ إبليس للائحة الدعوى).
Case dismissed as frivolous.
نظراً لذلك، قررت المحكمة رد الدعوى على أنها غير منطقية.
